1 . Heard learned counsel for the applicant as well as learned A.G.A. and perused the record.

2. The present application has been filed under Section 438 of Cr.P.C. seeking anticipatory bail apprehending arrest in FIR No.116 of 2024, under Sections 419, 420, 467, 468, 471, 120B IPC, Police Station Hazratganj, District Lucknow.

3 . This is the second anticipatory bail application. The first anticipatory bail application was rejected vide order dated 01.07.2024 passed in Criminal Misc. Anticipatory Bail Application No.1382 of 2024.

The contention of the Counsel for the applicant is that the FIR in question was lodged on 30.04.2024 against as many as 7 persons alleging that they had obtain diploma certificate and based upon which, they had taken employment. Subsequently, the said diploma certificate was found to be unlawful. The diploma certificate was furnished for employment sometime in the year 2022.

5 . The Counsel for the applicant argues that the applicant resigned within one month from the grant of employment. He further argues that the other co-accused have been granted the benefit of anticipatory bail by co-

ordinate Bench, which are on record.

6 . Learned A.G.A. also vehemently opposed the bail prayer.

Considering the fact that the co-accused on similar allegations have been granted the benefit of anticipatory bail and prima facie, the need of arrest is apparently not evident and therefore, the applicant is entitled for the benefit of anticipatory bail. Accordingly, the anticipatory bail application is allowed .

8 . In the event of arrest, let the applicant Km. Anuradha Verma be released on anticipatory bail in the abovesaid first information report number till submission of the charge-sheet on her furnishing personal bond and sureties of Rs.5,000/- to the satisfaction of the Investigating Officer concerned with the following conditions:

(i) The applicant shall make himself available for interrogation by a police officer as and when required and will co-operate with investigation;

(ii) The applicant shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer and

(iii) The applicant shall not leave India without the previous permission of the Court.
