(1) Heard the learned counsel for the petitioners and Shri Devrishi Kumar, Advocate, who appears for the Staterespondents nos.1, 2 & 3.
(2) This petition has been filed by the petitioner for the following prayers:-
"i) to issue a writ, order or direction in the nature of Certiorari quashing the Condition No.1 of Tender Notice/ Expression of Interest Document issued by the Medical Department, N.E.R., Lucknow, under the heading of "Financial Eligibility Criteria" in respect of surplus of medicines to the Hospitals of the Opposite party no.3 (Annexure-1 to the writ petition) so far as it relates to the petitioners.
ii) to issue a writ, order or direction in the nature of Mandamus directing the Respondent-authorities not to impose Condition No.1 of Financial Eligibility Criteria upon the (Annexure-1 to the writ petition) enabling them to submit their bid.
iii) to issue any other suitable writ, order or direction, which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case."
(3) Let counter affidavit be filed within two weeks.
(4) List this matter on 25.10.2024, as fresh.
(5) It is clarified that in case any Bid is accepted, it shall be subject to further orders in the writ petition.
(6) Office is directed to print the name of Shri Devrishi
Kumar as appearing for the Respondents in the cause list whenever the case is listed next.
