Heard learned counsel for the petitioner and learned Standing Counsel who appears on behalf of the State-respondents.
This writ petition has been filed by the petitioner with the following main prayer:-
"(i) issue a writ order or direction in the nature of Mandamus commanding the opposite party No.1 to pass the order by giving direction to Record Officer to tress out the consolidation record in respect of village Loshanpur, Pargana Jagdishpur, Tehsil Musafirkhana, District Sultanpur (Now Amethi).
(ii) issue a writ order or direction in the nature of mandamus commanding the opposite party No.2 & 3 to give the dispatch number and date to Record Officer Collectorate Sultanpur on which date the record was submitted after completion of Consolidation proceedings."
It is the case of the petitioner that the Collector of a district is responsible for maintaining the record after consolidation operation is over. However, the petitioner even after application made following due procedure, has not been given the record relating to consolidation proceedings completed much earlier with regard to village Loshanpur, Pargana Jagdishpur, Tehsil Musafirkhana, District Amethi.
Learned Standing Counsel, on the basis of instructions, says that the record is around 35 years old and earlier village Loshanpur was in District Sultanpur and sometime may be granted to the respondents to trace out the record. These instructions have been sent by the Consolidation officer, Musafirkhana.
List this matter on 20.9.2024.
In the meantime, the respondent nos. 3 and 4 shall file counter affidavit.
