Heard learned Counsel for the petitioner, Shri Manish Jauhari, learned Counsel appearing for the opposite parties no. 2 to 4. Shri Krishna Lal Yadav, Advocate has filed his memo of appearance on behalf of the opposite party no. 1.
This petition has been filed with the following prayers:-
"(i) Certioari for quashing of the order dated 10.07.2024 passed by opposite party no. 4 by means of which representation / complaint of the petitioner including the claim of the petitioner was rejected by giving vague reasons, as contained in Annexure No. P1 to this writ petition.
(ii) Certiorari for quashing of the order/result dated 07.03.2024, declared by opposite party no. 3, through which Opposite Party No. 5 has been selected for service provider, for being arbitrary, unfair and in illegal manner as contained in Annexure No. P2 to this writ petition.
(iii) Mandamus summoning the records of the petitioner and the Applicant awarded for the allotment of COMPANY OWNED COMPANY OPERATED Aliganj (O.P. NO. 5).
(iv) Mandamus directing the opposite parties no. 2 to 4 to award full marks (30) in the Financial Capability and revise and reissue the merit list keeping all other values same."
Issue notice to the opposite party no. 5.
The petitioner shall take steps both ways and file affidavit of service within a period of two weeks.
List/Put up this case on 20.08.2024.
In the meantime, pleadings be exchanged between the parties.
Till the next date of listing, no letter of intent, if it has not been issued till date, shall be issued by the opposite party no. 5.
It will be open for the opposite party no. 2 to 4 to complete other proceedings regarding selection but no letter of intent shall be issued.
