Heard learned counsel for the petitioner, learned Standing Counsel who appears on behalf of State respondents and Shri Sarvesh Kumar Dubey who has accepted notice on behalf of opposite party no.5.
This petition has been filed with the following main prayer :-
Learned counsel for the petitioner has pointed out Annexure – 4 to the petition which is a letter sent by Executive Engineer of Provincial Division of Lok Nirman Vibhag, Pratapgarh dated 19.11.2023 sent to the SDM, Sadar, Pratapgarh wherein reference has been made to the petitioner's application under RTI Act and a letter sent by the Chief Revenue Officer dated 02.11.2023. In the said letter of the Executive Engineer to the SDM Sadar, Pratapgarh it has been mentioned that part of Gata No.2266 and Gata No.2267 has been taken for construction of a link road in District Pratapgarh joining with the Ayodhya/ Faizabad National Highway near Sai river. The land of only 0.034 hectare was purchased by the petitioner who is a co tenure holder. A request has been made that the SDM should direct demarcation of land taken for the purpose of construction of the link road/ approach road as aforesaid.
Learned Standing Counsel shall seek instruction with regard to the steps taken by the SDM Sadar, Pratapgarh in pursuance of the letter dated 19.11.2023 sent by the Executive Engineer – Opposite party No.4.
