the respondent no.3 used to earlier work in some private firm, but later on has remained unemployed. There is a matrimonial dispute between the petitioner no.1 and the respondent no.3. The respondent no.3 has filed a Divorce Petition on 17.09.2020 in the Family Court registered as Case No. 2393 of 2020 on grounds of adultery. The petitioner no.1 was posted at Haidergarh, Barabanki at the time when the writ petition was filed, but it has now been informed by her counsel that she has been transferred to Agra. The petitioner no.1's children i.e. petitioner no.2 and 3 used to live with their father and paternal grandmother in the house situated at Vikash Nagar, Lucknow, which belongs to their father and grandmother. Due to the convenience of the children in attending school without any hindrance, the petitioner no.1 has left her children in her matrimonial home at Vikash Nagar, Lucknow, while she is living at her place of posting, but her children had informed her that the respondent no.3 locks the front door of the house and prevents them from going to school. The petitioner no. 1 made a compliant in this regard to the Police, but the Police had refused to interfere in the matter. The respondent no.3 has refused to maintain the family, and therefore, the petitioners have filed a Suit for Maintenance under Sections 18 and 20 of Hindu Adoption and Maintenance Act in May, 2024. The respondent no. 3 having stopped the education of the petitioners no.2 & 3, the petitioners no.2 & 3 have also written a complaint to the Commission for Protection of Child Rights, a copy of such complaint dated 10.06.2024 has been filed as annexure no.05 of the writ petition.
