Learned counsel for the petitioner submits that an award was passed in favour of the petitioner in the year 2010. Now the restoration application has been filed by the respondent no. 3, however, there is no stay of the award.
At this stage, learned counsel for the petitioner submits that he may be permitted to withdraw the writ petition with liberty to approach the labour court for execution of the award.
The writ petition is, accordingly, dismissed as withdrawn with the aforesaid liberty. It is provided that in case any application for execution of award is filed by the petitioner before the labour court the same shall be considered in accordance with law in a time bound manner.
