and is engaged in real estate business and development of residential and commercial building etc. from the last nineteen years. The petitioner purchased a plot of land admeasuring 6868.61 sq. meters, out of total area admeasuring 10,115.69 sq. meters of land bearing Khasra No.384 situated in VillageUjariyan, Pargana, Tehsil and District-Lucknow from its erstwhile owner,namely, M/s Parmeshwar Colonizers by means of a registered sale deed executed on 04.01.2006 for a sale consideration computed at commercial rates as per the Collector's rate list. The petitioner purchased the remaining area of 3247.08 sq. meters, out of total area of the total area of 10,115.69 sq. meters of the land bearing Khasra No. 384 situated in Village-Ujariyan, Vibhuti Khand, Gomti Nagar, Pargana, Tehsil and District Lucknow from its erstwhile owner, namely, M/s Parmeshwar Colonizers by means of second registered sale deed executed on 15.06.2006. The petitioner thereafter applied for sanction of map to the Lucknow Development Authority, which was granted vide Permit bearing no.26221 on 04.12.2006. Certain objections were raised with regard to certain proposals made in the layout map and compounding proceedings were adopted. Certain charges were made on 15.12.2006 with the petitioner. The petitioner paid all dues towards inspection fees, water charges, external development charges and purchasable floor area ratio (FAR) etc. as demanded by the Lucknow Development Authority. At no point of time, land used conversion charges were demanded from the petitioner, as the land in question was already earmarked for commercial use.
