(1) Heard the learned counsel for the petitioner and Shri Puneet Chandra, learned Standing counsel who appears for the Opposite party nos.1 to 4.
(2) This petition has been filed by the petitioner for the following main prayer:-
"1) To issue a writ, order or direction in the nature of Mandamus commanding the Opposite parties to take appropriate decision on the Representation of the petitioner and provide him the calculated amount of development fee as much he may deposit the same and the land in question (1 Biswa land measuring area about 1296 square feet of Khasra No.732, situated in Village Kharika, Pargana Bijnaur, Tehsil and District Lucknow) which is annexed as Annexure no.1 to this writ petition, may be adjusted in his favour."
(3) Learned Standing Counsel says that he has received detailed instructions with regard to the allegation and he has also pointed out Annexure No.18, Page no.42 of the paper book where a letter has been issued by the Executive Engineer to the petitioner regarding lack of locus to develop the land, he wishes to develop.
(4) Let a counter affidavit be filed within a period of four weeks. Two weeks' time thereafter is given to the petitioner to file his rejoinder affidavit.
(5) List this matter in the third week of July, 2024 .
