Heard Shri Sunil Kumar Singh, learned counsel for the petitioner and Shri Mukul Tripathi, learned Standing Counsel for the State.

Present petition has been pressed for the following relief:-

"(a) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no.3 to take necessary action for making the entry in the Income Tax Return of the petitioner against the PAN No.BHGPS 2399Q having total amount of Rs.95105.00 (Ninety Five Thousands One Hundred Five) which has been deducted from the petitioner as T.D.S. amount while making the payment of Rent to the petitioner."

On 14.08.2024 we had passed the below quoted order:-

"1. Learned Additional Chief Standing Counsel may obtain instructions as to why TDS deducted from the payment made from the petitioner has not been accounted by due deposit against the PAN of the present petitioner.

2. Put up as fresh on 18.09.2024.

3. If the claim made by the petitioner is true and correct, remedial action will be taken in the meantime."

Today, Shri Mukul Tripathi, learned Standing Counsel states, in compliance of the last order T.D.S. amount of Rs.15,851/- has been credited against PAN of the petitioner. As for the balance amount Rs.79,254/-, verification is being made as desired by the Chief Revenue Officer, Varanasi. It has been assured that due action would be completed within a period of one month from today.

In view view of that statement made, no further direction is required. Accordingly, the present writ petition is disposed of in terms of the statement made by Shri Mukul Tripathi, learned Standing Counsel for the State.
