Supplementary affidavit filed by learned counsel for the petitioner is taken on record.

Learned counsel for the petitioner is permitted to implead- Public Information Officer, Shahjahanpur as respondent no.4 in the array of the parties to the writ petition during course of the day.

Heard learned counsel for the petitioner, Mr. Kunal Ravi Singh, learned counsel for respondent no.2 and Mr. Shyam Singh, learned Standing Counsel for the State-respondents.

The instant petition has been filed for the following reliefs:

"i. issue a writ, order or direction in the nature of mandamus directing the respondent nos.2 & 3 to provide information to the petitioner under Right to Information Act, 2005 regarding question raised by the petitioner in application dated 1.9.2021 within short and stipulated period.

ii. issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no.3 deciding representation dated 1.9.2021 within stipulated and reasonable period."

Learned counsel for the petitioner submitted that vide order dated 31.10.2022, an order was passed in Appeal No.S-9-2966/ A / 2022 disposing of the matter with the observation that the opposite party shall complete the proceeding on the basis of application filed by the petitioner, under Section 6-1 of the Right to Information Act, 2005 read with Right to Information Rules, 2015. He further submitted that petitioner although filed a recall application against the order dated 31.10.2022, which has been rejected by the order dated 20.7.2023 but petitioner is not challenging the order dated 31.10.2022 or 20.7.2023 rather seeking direction for compliance of the observation made in the order dated 31.10.2022.

Considering the facts and circumstances of the case, the instant petition is finally disposed of directing respondent no.4 to make compliance of the order dated 31.10.2022 passed by respondent no.2 in accordance with law,

expeditiously preferably within a period of two months from the date of production of certified copy of this order before respondent no.4.
