1. Heard Sri Ram Rang Patel, learned counsel for the petitioners, Sri Paras Nath Rai, learned Standing Counsel appearing for respondent no. 1 and Sri Anurag Yadav, learned counsel appearing for respondent no. 2.

2. The instant petition has been filed praying for a direction to the District Magistrate to decide the claim put forth by the petitioners under Section 3G(5) of National Highways Act, 1956 in relation to an award given under the provisions of the Act.

3. Sri Rajiv Gupta, learned Additional Chief Standing Counsel appearing for the State-respondents has placed on record a notification dated 11.05.2020, by which Additional Commissioner, Prayagraj has been appointed as statutory Arbitrator for dealing with the matter under Section 3G(5) of the Act.

4. Sri Mahendra Pratap, learned counsel appearing for N.H.A.I. informs that the award was delivered by Competent Authority on 06.02.2019.

5. Since, the petitioners have filed claim before a wrong authority, therefore, we refrain from issuing any direction in the instant matter. We leave it open to the petitioners to approach the appropriate authority with their claim and in which event, we hope and trust that the claim would be decided in accordance with law expeditiously.
