Heard Sri V.K. Singh, learned counsel for the petitioner and Sri Jitendra Narain Rai, learned Additional Chief Standing Counsel for the State-respondents.

This Court vide order dated 16.05.2024 passed the following order:

"1. In compliance of this court's order dated 14.5.2024, learned Standing Counsel has received instructions from Additional Secretary, Madhyamik Shiksha Parishad, Regional Office, Varanasi vide his letter dated 14.5.2024. The aforesaid instructions have been produced before this court. Paragraph 8 of the aforesaid instructions is extracted as under:

"8. प्रश्नगत प्रकरण मम ययाचची छयात्र दयारया अपनची जन्मततथथि 18.09.2009 कके स्थियान पर 18.09.2002 नहहीं अतपतत 10.10.2000 ( जजो तविघयालयचीय अतभिलकेख कके अनतसयार प त ष्टित वि प्रमयातणत हह ) ससंशजोथधित तकयके जयानके ककी मयासंग ककी जयातची हह , तजो पररषद कजो ममूल तविदयालयचीय अतभिलकेखखों तथिया ककया -9 पसंजचीकरण कके अनतसयार ययाचची छयात्र ककी जन्मततथथि 18.09.2009 कके स्थियान पर 10.10.2000 संशजोथधित तकयया जयानया तविचयारणचीय स / अनतमन्य हजोगया। "

From perusal of the aforesaid instructions provided by the letter dated 14.5.2024, it is apparent that respondents have virtually accepted that petitioner's date of birth is 10.10.2000, whereas due to some mistake petitioner's date of birth in High School marksheet and certificate has been recorded as 18.9.2009.

3. Since the authorities of the Madhyamik Shiksha Parishad, Varanasi have accepted their mistake and they are willing to correct the date of birth by replacing 18.9.2009 by 10.10.2000 therefore, let the correction be carried out within one month from today.

4. List this matter on 8.7.2024 as fresh.

5. On the next date, corrected marksheet and certificate of the petitioner shall be produced by the respondents before this Court."

Pursuant to the aforesaid order, learned Additional Chief Standing Counsel has produced before this Court the High School Examination-2018 certificate-cummarksheet in original, which reflects that the date of birth of the petitioner is Tenth October Two Thousand (10.10.2000).

Since the claim of the petitioner has been accepted by the respondents correcting the date of birth as 10.10.2000, therefore nothing survives in the present petition.

In view of the aforesaid fact, no useful purpose would be served to keep this writ petition pending. Accordingly, this Court is of the considered view that the present writ petition be disposed of with a direction to the respondent no.2 to send the said marksheet to the respondent-College namely Sri Brahm Dev Sudeshwari Inter College, Maheshpur, Ghazipur to issue the same to the petitioner in accordance with the relevant rules, as expeditiously as possible say preferably within a period of ten days from the date an appropriate application is moved before the authority.

The aforesaid certificate-cum-marksheet dated 29.04.2018 issued in the name of the petitioner is returned to the learned Additional Chief Standing Counsel for necessary steps.

With the aforesaid direction, the writ petition is disposed of .
