Heard Sri Pradeep Kumar Upadhyay, learned counsel for petitioners and Sri Anshul Nigam, learned Standing Counsel for the State-respondents No. 1, 2, 3 and 4.

By means of the present writ petition, the petitioners assailed the order dated 14.6.2024 passed by the District Inspector of Schools, Prayagaraj as contained in Annexure No. 1 to the writ petition.

By means of the impugned order dated 14.6.2024, District Inspector of Schools, Prayagaraj directed for single operation of Salary Disbursement Account of the petitioner.

This Court, vide order dated 8.7.2024 granted time to learned counsel appearing on behalf of State to seeks instructions in the matter.

Contention of learned counsel for petitioners is that the impugned order is per-se is illegal as same was passed in utter disregard to the conditions as stipulated under Section 5 (1) of Payment of Salary Act, 1971 and the rules made thereunder.

Learned Standing Counsel on the basis of written instructions received from the District Inspector of Schools, Prayagaraj dated 18.7.2024 submits that the impugned order regarding single operation of 'salary disbursement account' was only in respect of the period of April to May, 2024. He further submits that from the month of June, 2024 onward the Account in question is in operation under the signature of the Manager of the Institution and the Finance and Account Officer in the office of District Inspector of Schools, Prayagaraj. Since the effect of the impugned order has already came to an end after the month of May 2024, therefore, the present writ petition has now lost its efficacy.

In view of the aforesaid facts and the statement made by learned Standing Counsel the present writ petition has been rendered infructuous. Accordingly, the same is consigned to record .
