Heard Sri Shamasul Eslam, learned counsel for the petitioner and Sri S.N. Srivastava, learned Additional Chief Standing Counsel appearing for the State-respondents.

The present petition has been filed seeking a direction to respondent no. 8/Tehsildar, Tehsil Sadar, District Ballia to decide the case no. T2010150903567 (Roshan Ara vs. Ghuran), under Section 33/34 of the U.P. Revenue Code, 2006, within a stipulated time period.

Counsel for the petitioner has referred to the order sheet of the case, a copy whereof has been filed along with this petition, to contend that although various dates are being fixed for hearing but for some reason or the other the matter is being adjourned and the delay in disposal of the said case is causing undue hardship to the petitioner. Accordingly, a prayer is made to expedite the proceedings.

Counsel for the State-respondents submits that as per his instructions the date fixed in the case is 01.08.2024 and the efforts would be made to conclude the proceedings at an early date.

Having regard to the aforementioned facts and circumstances and without expressing any opinion on the merits of the case, the present petition is disposed of with an observation that the court concerned would be expected to make an endeavor to decide the aforesaid case in accordance with law, expeditiously preferably within a period of three months from the date of production of certified copy of the instant order, provided there is no other legal impediment.
