Heard learned counsel for the petitioners, learned counsel for the State-Sri Hemant Kumar Pandey and also Sri Pankaj Gupta, learned counsel for the Gaon Sabha concerned.

Present petition has been filed for the following main relief:-

"Issue a writ order or direction in the nature of Certiorari for quashing the impugned order dated 9.8.2023 passed by the opposite party No.1 in review petition No.247/2003-2004, computerized case No. R200409380019444 and order dated 26.4.2004 passed in revision No.210 (L.R.) 2003-04, contained as Annexure No.1 & 2 as well as the impugned order dated 27.3.2004 passed by the opposite party No.2 in appeal No. 168/27/D-1989, contained as Annexure No.10 to this writ petition."

A perusal of impugned order(s) dated 09.08.2023 and 26.04.2004 indicate that initial order dated 08.11.1989 was passed against the dead persons and to the same effect concurrent findings of facts have been recorded, as such, based upon the material available on record, this Court is not inclined to interfere in the impugned order(s) dated 09.08.2023 and 26.04.2004 in exercise of power under Article 226 of the Constitution of India.

Accordingly, the petition is disposed of with liberty to petitioners to avail the appropriate remedy, as available to them, under the U.P. Revenue Court, 2006.
