Pursuant to the orders dated 01.08.2024 and 12.08.2024 passed by this Court, the report of the Chief Medical Officer, Moradabad in the sealed cover has been submitted by the learned Standing Counsel before this Court, the same has been open by the Court. The aforesaid report is quoted as under:-

शरमतर खदरजसा बबेगम पत्नर समुल्तसान अहमद आयमु लगभग 71 वरर चनवसासर मम0 बरवलसान थसानसा ममुगलपमुरसा जनपद ममुरसादसाबसाद जबो शरमतर सदफ समुल्तसान किकी मसातसा हहै किसा मसाननरय उच्चि न्यसायसालय , इलसाहसाबसाद किबे ररट ए नम्बर 9643 वरर 2024 किबे क्रम मम आदबेश चदनसानांकि 01.8.2024 किबे अनमुपसालन स्वयनां किबे स्वसास्थ्य पररक्षण हबेतमु ममुख्य चचिचकित्ससाधधिकिसारर, ममुरसादसाबसाद दसारसा गचठित चचिचकित्ससा दल किबे समक्ष चदनसानांकि 09.8.2024 किबो उपसस्थत हहयर। उनकिबे पररक्षण एवनां उनकिबे दसारसा लसायबे गयबे उपचिसार सनांबनांधिर प्रपतत्रों किकी छसायसाप्रचतयत्रों किबे अवलबोकिन किबे पश्चिसात उनकिबो जसाजाँचित्रों हबेतमु धजलसा चचिचकित्ससालय, ममुरसादसाबसाद किबो चदनत्रोंकि 09.8.2024 किबो भबेजसा गयसा।

वह अपनर जसाजाँचिम किरसानबे किबे पश्चिसात जजॉचि ररपबोटर सचहत आज पमुननः चदनजॉकि 12.8.2024 किबो बबोरर किबे समक्ष उपसस्थत हहययीं। उनकिबे दसारसा लसायर गयर सभर ररपबोटरस एनांव उनकिबे पमुननः चचिचकित्सरय पररक्षण किबे उपरसान्त यह पसायसा गयसा चकि शरमतर सदफ समुल्तसान किकी मसातसा शरमतर खदरजसा बबेगम पत्नर समुल्तसान अहमद आयमु लगभग 71 वरर चनवसासर मम० बरवलसान थसानसा ममुगलपमुरसा जनपद ममुरसादसाबसाद इस समय चकिसर गनांभरर बरमसारर सबे ग्रधसत नहर हह।

चचिचकित्सकि दल किकी आख्यसा एनांव एक्स -रबे, पहैथबोलजॉजर ररपबोटर एनांव ई०सर०जर० ममुख्य चचिचकित्ससा अधधिकिसारर , ममुरसादसाबसाद किबो अचग्रम किसायरवसाहर हबेतमु प्रबेचरत।

From perusal of the aforesaid report, it is clear that Committee was constituted by the Chief Medical Officer, Moradabad under the supervision of Senior Officers of the Hospital. After going through the same it is clear that at present the mother of the petitioner is not suffering from any serious disease. After perusal of the same,

the report has been returned to the learned Standing Counsel.

The fact as contained in the writ petition that the mother of the petitioner is suffering from the serious illness is not supported by any affidavit, hence the relief sought by the petitioner could not be granted to him.

At this point of time, a prayer has been made by the counsel for the petitioner that the petitioner may be permitted to submit a representation before the concerned competent authority.

On the other hand, it is argued by the learned Standing Counsel as well as by Smt. Archana Singh, learned counsel appearing on behalf of respondents that in case the petitioner will join his transferred post and thereafter submit his representation before the concerned competent authority, the concerned competent authority will consider the representation submitted by the petitioner and will pass appropriate orders on the same.

In this view of the matter, petitioner is permitted to join his transferred post within a period of two weeks from today. Failing which, the respondents are free to initiate disciplinary proceedings against the petitioner. In case the petitioner shall join his transferred post within a period of two weeks from today thereafter he will submit a representation before the concerned competent authority, annexing the copy of joining report. In case it is so, the concerned competent authority will do the needful in the matter.

With the aforesaid observations, the writ petition is disposed of finally.
