The claim of the petitioner has been rejected by passing the following order dated 10.04.2024 :-

"उपरक्त बबिषरक आपकके पत्र बदिनननांक र 09.04.2024 कके कग मम अवगत करननन हह बक अपर बनदिकेशक , ककोषनगनर पकेशन बिरकेलली मण्डल बिरकेलली कके दनरन परलीक्षण मम शनसननदिकेश सनां० -94/ अडषठ-3-2021-ररट-288/2014 बदिनननांक 24.02.2021 कके अनरसनर ममृतक चत र र शकेणली कमरचनरररयों कको गकोच्ररटली ककी सरबवधन अनरमन्र नहली हह। गकेच्ररटली ककी सरबवधन 60 वषर ककी अधधवषरतन आरर पर अनरमन्र हह।"

Counsel for the petitioner placed reliance upon paragraph 3 of the Government Order dated 24.02.2024, which reads as follows :-

"3- शनसन दनरन सम्रकक बवचनरकोपरनन्त प्रदिकेश कके अशनसककीर सहनरतन प्रनप जजू०हन०स्कजूलयों मम तमृतलीर शकेणली कनबमरकयों ककी भनभाँबत बदिनननांक -01.04.2005 सके पजूवर - बनररक्त चत र र शकेणली कमरचनरररयों कको उनककी सकेवनबनवमृधत्ति कके उपरनन्त बतधर 25.08.2005 सके गकेच्ररटली ककी सरबवधन अनरमन्र बकरके जननके ककी शली रनज्रपनल सहषर स्वलीकमृबत प्रदिनन करतके हह।

कमृपरन तद्नरसनर अगतर आवश्रक कनररवनहली करननन सरबनशश्चत करम।"

Sri Devesh Vikram, Advocate, normally appearing on behalf of District Basic Education Officer is appointed as amicus curiae in the matter to assist the Court.

Two weeks' time is granted to counsel for the respondents to file counter affidavit.

Put up as fresh on 07.08.2024 showing the name of Sri Devesh Vikram (A-D 0177-2012) as amicus curaie to assist the Court.
