Heard learned counsel for petitioner, learned State Counsel for opposite parties 1 and 2 and Mr. Akash Singh learned counsel for opposite party No.3.

Petition has been filed seeking a direction to concerned authority for payment of salary and other entire service benefits considering petitioner to be in service.

Learned counsel for opposite party No.3 has raised a preliminary objection regarding maintainability of this petition in view of the fact that petitioner was admittedly appointed in Kisan Sahkari Sugar Mill Limited, Akbarpur as stated in paragraph 3 of the writ petition itself but the said establishment has not been arrayed as opposite party. It is further submitted that aforesaid sugar mill was never a part of U.P. Cooperative Sugar Factories Federation Limited and was in fact an independent entity.

Learned counsel for petitioner admits that aforesaid sugar factory has subsequently been closed and is not in existence at present as admitted in paragraph 10 of the writ petition itself.

In view of aforesaid facts and circumstances particularly since the aforesaid establishment is no longer in existence, the relief as sought for by petitioner can not be granted.

The petition therefore fails and is dismissed. Parties to bear their own cost.
