Heard Shri H G S Parihar, learned Senior Advocate, assisted by Ms Meenakshi Singh Parihar, learned counsel for the petitioner and Shri Vivek Shukla, learned Additional Chief Standing Counsel for the respondents no. 1 to 6.

Despite issuance of notice to respondents no. 7 and 8, they have failed to respond.

As per office report dated 06.03.2024 notice is deemed sufficient on respondents no. 7 and 8. Accordingly, the Court proceeds to hear and decide the matter finally.

There is consensus at the bar that so far as the order impugned in the instant writ petition is concerned, the same is squarely covered by principle of law enunciated by this Court in a bunch of writ petitions leading being Writ A 8517 of 2023 in re: Tirthraj vs State of U.P. and others decided on 17.05.2024.

Considering the aforesaid consensus, the writ petition is allowed .

The order impugned dated 06.10.2023, a copy of which is annexure 1 to the writ petition, passed by the respondent no. 4 is quashed.

The competent authority is directed to pass a fresh order in accordance with law and relevant rules considering the judgement of this Court in the case of Tirthraj (supra).

Let such an order be passed within a period of six weeks from the date of receipt of a certified copy of this order.

In case any dues are admitted by the respondents, the same wold be paid to the petitioner within the aforesaid period provided there is no legal impediment.
