A preliminary objection has been raised by learned Standing Counsel and learned counsel for the respondent no. 2 that present writ petition has been preferred for quashing of the transfer order passed on 12.12.2017 after a delay of more than 6 years.

At this stage, learned counsel for the petitioner has submitted that a liberty may be given to the petitioner to move a representation before the respondent no. 4, who may also be directed to consider and decide the representation of the petitioner within the time as this Court may deem fit and proper.

Learned Standing Counsel and learned counsel representing the respondent no. 2 have no objection to the prayer made by learned counsel for the petitioner.

On the request of learned counsel for the petitioner and without entering into merit of the case, the present writ petition is disposed of with a liberty to the petitioner to move a representation before respondent no. 4 alongwith certified copy of this order within a period of two weeks from today. In case any such representation is made, the same shall be decided by the respondent no. 4-Chief Medical Officer, Lakhimpur Kheri within a period of six weeks, thereafter, in accordance with law.
