A preliminary objection has been raised by Shri S.B. Pandey, learned Additional Solicitor General of India assisted by Shri Varun Pandey, learned counsel for the Union of India and Sri Alok Kumar, learned counsel for the Union Public Service Commission that the petitioner has a statutory remedy to approach the Central Administrative Tribunal being a retired Central Government Servant.
At this stage, learned counsel for the petitioner has submitted that the petitioner may be permitted to withdraw the present writ petition as dismissed as not pressed with liberty to approach the Central Administrative Tribunal.
As prayed, the present writ petition is dismissed as not pressed with the aforesaid liberty.
