The present writ petition has been preferred seeking direction to the opposite parties to appoint the petitioner on the compassionate ground (against substantive vacancy) under the Scheme of Dying in Harness Rules, 1974 in place of his father.

Learned Standing Counsel has raised a preliminary objection that the brother of the petitioner namely Manoj Kumar had approached this Court by filing Writ A No. 9630 of 2023 which has been disposed of by judgment and order dated 16.12.2023 with a direction to the authorities to decide the representation of the petitioner of that writ petition after affording opportunity of hearing to all heirs of the deceased.

In reply, learned counsel for the petitioner has submitted that Manoj Kumar had not disclosed the fact that the other dependents of the deceased employee have given afÏdavits in favour of the present petitioner. It is further submitted that the authorities are not hearing the petitioner and after arguing at some length, learned counsel for the petitioner has submitted that the petitioner may be permitted to withdraw the present writ petition as dismissed as not pressed with liberty to either file a review application for review of judgment and order dated 16.12.2023 passed in Writ A No. 9630 of 2023 (Manoj Kumar vs. State of U.P. and Ors.) or prefer a Special Appeal or Contempt petition against the same.

As prayed, the present writ petition is dismissed as not pressed with the aforesaid liberty.
