Heard Shri Ranjeet Singh, learned counsel for the petitioners and learned Standing Counsel for the Staterespondents.
Petitioners claim that they are entitled to salary for the period from 01.07.2015 to 09.10.2015. A representation in this regard has been made by the petitioners but to no avail.
Learned Standing Counsel contends that the claim of the petitioners requires factual adjudication in the light of applicable law by the competent authority in the first instance. However, he fairly submits that such determination is liable to be decided within a reasonable period of time.
In the wake of preceding discussion and without going into the merits of the case, the respondent No.5-Finance & Accounts Officer, Basic Education, Office of District Basic Education Officer, Bareilly shall decide the claim of the petitioners for payment of salary for the aforesaid
period as per law, preferably, within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation.
With the aforesaid direction, the writ petition is finally disposed of.
