Heard Shri Prabhakar Awasthi, learned counsel assisted by Shri Bal Mukund Singh, learned counsel for the petitioner and Shri Subhranshu Shekhar Singh, learned Additional Chief Standing Counsel for the State.
Shri Subhranshu Shekhar Singh, learned Additional Chief Standing Counsel submits that the petitioner's husband is gainfully employed. He is holding the post of Assistant Manager (HR and Administration) in the company running under the name and style of S.K. Samanta and Company (P) Ltd. He draws a regular salary. His basic pay fixed in the year 2018 was 14,700/-. He calls attention to the appointment letter of the petitioner's husband appended as Annexure No. 3 to the writ petition.
The petitioner was married in the year 2012. There is nothing in the record to demonstrate that the petitioner was dependant on her mother or that she is living separately from her husband. The petitioner has sought to hoodwink the authorities and this Court. She is not entitled
to appointment on compassionate grounds.
According the learned Additional Chief Standing Counsel the prerequisites for grant of appointment on compassionate grounds namely dependency of the applicant on the deceased employee, immediate financial hardship resulting from the death of such employee are not disclosed from the admitted facts of this case. Compassionate ground appointment is not a regular source of appointment or a largest for the family of the deceased employee. These relevant factors have been duly considered in the impugned order.
Faced with this Shri Prabhakar Awasthi, learned counsel assisted by Shri Bal Mukund Singh, learned counsel for the petitioner submits that the petitioner does not wish to press the writ petition.
The writ petition is dismissed.
