Heard Sri Surya Mani Singh, learned counsel for the petitioner as well as learned Standing Counsel for respondent nos. 1 to 4 and Sri Raj Kumar Upadhyaya, learned counsel appearing for respondent no. 5.

Grievance raised by the petitioner in the present writ petition is with regard to non consideration of his candidature for promotion to the post of Statistics Officer.

It is submitted by learned counsel for the petitioner that petitioner was appointed on the post of Field Investigator in 2011 and subsequently nomenclature of the said post was changed to Additional Statistics Officer and the petitioner was also confirmed on the said post in 2015.

It is next submitted by learned counsel for the petitioner that petitioner is fully eligible for being promoted to the post of Statistics Officer and also that posts are vacant but still respondents have not constituted DPC for consideration of petitioner for promotion and consequently by means of present writ petition prayer has been made seeking suitable directions to the respondents to consider the petitioner for promotion to the post of Statistics officer.

Learned Counsel for the petitioner after arguing the matter up to some length has submitted that grievance of petitioner shall be substantially redressed in case respondent no. 2 - Principal Secretary, Department of Sugar Industry and Cane Development, Government of U.P. Lucknow is directed to consider and decide his representation in this regard expeditiously.

Learned Standing Counsel has no objection to the limited prayer made by learned counsel for the petitioner.

Accordingly, present writ petition is disposed of with direction to respondent no. 2 - Principal Secretary, Department of Sugar Industry and Cane Development, Government of U.P. Lucknow to consider and decide representation of petitioner dated 03.05.2024 (annexed as Annexure - 2 to the writ petition), expeditiously, say within six weeks from the date of production of certified copy of this order, in accordance with law and communicate the decision to the petitioner.
