This writ petition has been filed seeking a direction upon Additional Director of Education (Rajkiya), Directorate of Education, U.P. Prayagraj, respondent no. 3, to take appropriate decision on the recommendations made by the District Inspector of Schools, Gorakhpur dated 21.03.2023 and pass appropriate orders.

Learned counsel for the petitioner submits that petitioner has been appointed as Peon in the institution in question under Dying-inHarness Rules. Petitioner had gone on medical leave and has resumed his duties. The District Inspector of Schools has sought permission from the Additional Director of Education for granting permission to permit the petitioner to join the institution and pay his salary in future and shall not be paid his earlier salary treating it to be sanctioned medical leave. The approval of the Additional Director of Education is still awaited.

As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed off, at the admission stage, without calling for counter affidavit with a direction upon respondent no. 3, Additional Director of Education (Rajkiya), Directorate of Education, U.P. Prayagraj, to take decision in the matter, in accordance with law, preferably within a period of two months from the date of production of certified copy of this order.

With the aforesaid directions, writ petition stands disposed off.
