Compliance affidavit filed today is taken on record.

On 21.08.2024, dasti summons were issued to respondent no. 5. According to compliance affidavit, the said dasti summons have been served upon respondent no. 5 on 27.08.2024.

Today, when the case was taken up, no one has put in appearance on behalf of respondent no. 5.

In view of above, notice upon respondent no. 5 is deemed sufficient.

This writ petition has been filed with the following prayers:-

"a) Issue a writ, order or direction in the nature of mandamus directing the Respondent No. 5 to declare the final selection list of Assistant Clerk / typing Recruitment, 2022-2023 as early as possible and within such shortest possible time frame with this Hon'ble Court may deem fit and proper in the facts and circumstances of the case in pursuant to letter cum Advertisement No. 2058/15.05-2021-1600(359)/2014 date 25.11.2021.

b) Issue a writ, order of direction in the nature of mandamus directing the Respondent no. 3 and 4 to take appropriate action on the representation of the petitioner dated 03.05.2024 pending in their respective office.

c) Issue a writ, order of direction in the nature of mandamus directing the Respondent no. 3 and 4 to take appropriate action the Respondent No. 5 for willful disobedience of Government order in accordance with law."

It is contended by learned counsel for petitioner that for the recruitment on the post of Assistant Clerk/ typing Recruitment 2022-23, a typing test has already been conducted by respondent no. 5 but the final select list has not been declared till date. According to him, it is the respondent no. 5/ Committee of

Management who has to declare the list.

After hearing learned counsel for petitioner as well as learned Standing Counsel, this Court finds that as per the averment made in the writ petition, typing test was held on 11.11.2022 but till date the result has not been declared. The petitioner had represented the matter before respondent no. 5 on 03.05.2024 & 06.02.2024, but the same are not attended.

As a last opportunity, two weeks time is granted to respondent no. 5 to declare the result for the selection of Assistant Clerk/ Typing Recruitment 2022-23, from the date of production of certified copy of this order. In case, the result is not declared, District Inspector of Schools, Gorakhpur is directed to take necessary action against respondent no. 5, in accordance with law, within next two weeks.

With the aforesaid directions, writ petition stands disposed of.
