Heard learned counsel for the petitioner and learned Standing Counsel for the State.

This writ petition has been filed with the following prayer:-

"I. Issue a writ order or direction in the nature of mandamus, commanding and directing the respondent authorities to consider the claim of petitioner for compassionate appointment on the post of Class IVth Employee in place of his father in Shri Jangali Baba Purwa Madhyamik Vidyalaya, Kathaura, District- Ballia, within stipulated period of time as fixed by this Hon'ble Court.

II. Issue a writ order or direction in the nature of mandamus, commanding and directing the respondents authority to decide the application dated 09.01.2024 (Annexure No. 5 to this Writ Petition) with regard to compassionate appointment, in the light of the judgments of this Hon'ble Court and to recruit the petitioner under Dying-in-Harness, within stipulated period as fixed by this Hon'ble Court."

It is contended by learned counsel for petitioner that an application for compassionate appointment has been moved by petitioner before respondent no. 3, which is pending consideration since 09.01.2024.

As no useful purpose would be served in keeping the matter pending, the matter is being disposed of at this stage without calling for counter affidavit, with a direction upon respondent no. 3 to take decision on the application of petitioner dated 09.01.2024, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of three months from the date of production of certified copy of this order.

With the aforesaid directions, writ petition stands disposed of.

It is made clear that the Court has not adjudicated upon the merits of the case.
