Hon'ble Ashutosh Srivastava,J.
By orders dated 31.08.2024 and 18.09.2024, learned Standing Counsel as well as Shri Sudhir Bharti, learned counsel appearing for the Gaon Sabha concerned were granted time to obtain instructions. Despite time having been granted by this Court, on two occasions, till date instructions have not been received.
In such circumstances, the Court is left with no option but to directing the personal presence of the Sub Divisional Magistrate, Kaptanganj, Tehsil-Kaptanganj, District-Kushinagar, to appear before this Court on 22nd October, 2024 and explain his conduct.
If the instructions or counter affidavit is filed to the writ PIL the concerned officer need not to appear in person.
List this case, as fresh, on 22nd October, 2024.
