Heard learned Counsel for the petitioner and Shri Vishal Tehlani, learned Standing Counsel for the respondents no. 1 to 3. Notice on behalf of respondent no. 5 has been accepted by Shri Mohan Singh.
No notice be issued to respondent no. 4 taking into consideration the nature of order proposed to be passed.
The instant petition in the nature of Public Interest Litigation has been filed praying for a writ of mandamus commanding the respondents to evict the encroachers from plot numbers 481 and 484 situated in Village Jaitpur, Tehsil Akbarpur, District Ambedkar Nagar recorded as Chakmarg in the revenue record.
The Court had required learned Standing Counsel to seek instructions.
Today Shri Vishal Tehlani, learned Standing Counsel, on the basis of instructions sent by the Tehsildar Akbarpur, District Ambedkar Nagar dated 05.02.2024 states that proceedings under the provisions of Section 67(1) of the U.P. Revenue Code, 2006 had been initiated against the encroachers for encroachment on the aforesaid gatas. The case had been decided but an application for recall has been filed by the private respondents and the matter is fixed now on the recall application. He states that the recall application could not be decided on account of lawyers abstaining from work.
He further states that endeavor would be made to decide the said recall application and the case itself in accordance with law within the time period fixed in Code 2006 and rules governing the same.
The aforesaid statement is recorded.
The writ petition is disposed of.
