Heard learned counsel for the applicant.

Present transfer application has been preferred for transfer of Case No.3210 of 2023, under Section 13(1)(i-a) of Hindu Marriage Act, 1955, Sankalp Tripathy Versus Aradhana Pandey, pending in the court of Additional Principal Judge-III, Family Court, Lucknow to be transferred to the court of Principal Judge, Family Court, Banda.

It has been submitted by learned counsel for the applicant that the applicant and the respondent no.2 are wife and husband having been married on 10.12.2018. Subsequently, the relationship between them became hostile due to which the applicant was forced to live with her parents at Sitapur.

It is stated that the applicant is financially dependent upon her parents with whom she is living in District - Banda, which is around 163 km from Lucknow and does not have any source of income. In these circumstances, it is difficult for her to pursue legal proceedings at Lucknow on each day of hearing.

In view of the aforesaid, the matter requires consideration.

¶10

Accordingly, issue notice to private respondent, returnable at an early date.

¶11

Learned counsel for the applicant shall take steps within a week.

List this case on 22.07.2024.

¶13

Till the next date of listing, proceedings of Case No.3210 of 2023, under Section 13(1)(i-a) of Hindu Marriage Act, 1955, Sankalp Tripathy Versus Aradhana Pandey, pending in the court of Additional Principal Judge-III, Family Court, Lucknow shall remain stayed.
