Heard learned counsel for petitioner, learned State Counsel for opposite parties no.1 to 5 and Mr. Pankaj Gupta, learned counsel for opposite party no.6.

Petition has been filed challenging order dated 28.03.2024 whereby petitioner has been removed from service as Panchayat Assistant/ Accountant-cum-Data Entry Operator of the Gram Panchyat concerned vide resolution dated 27.03.2024.

Learned counsel for petitioner is granted liberty to amend prayer clause of the petition to incorporate challenge to the resolution of Gram Panchayat.

In pursuance of directions issued earlier, Mr. Pankaj Gupta, Advocate, has been provided instructions and as per which there is a procedural defect in the resolution of the Gaon Sabha inasmuch as, it was not passed by 2/3 majority as is required. In such circumstances, Mr. Gupta submits that a liberty may be granted for consideration of the matter afresh.

In view of aforesaid facts and circumstances and particularly submissions of learned counsel for opposite party no.6, the impugned resolution dated 27.03.2024 and order dated 28.03.2024 are hereby quashed by issuance of a writ in nature of Certiorari granting liberty to opposite parties to consider matter afresh in the light of extant Rules and Government Orders.

Consequently, the petition succeeds and is allowed . Parties to bear their own costs.
