- अपपीललारर्थी कके वविदलान अधधिविकला कला करन हहै वक अधिपीनस्र न्यलायलालययों नके वबिनला अपपीललारर्थी दलारला प्रस्तसुत मिमौधखिक तरला अवभिलकेखिपीय सलाक्ष्ययों कला ससिंजलान धलए अविहैधिलावनक आदकेश पलाररत वकयला हहै। अपपीललारर्थी कके वविदलान अधधिविकला कला यह भिपी करन हहै वक प् र मि अपपीलपीय न्यलायलालय दलारला आदकेश 41 वनयमि 31 व्यविहलार प्रवक्रियला ससिंवहतला कला पलालन वकयके वबिनला अपपीलपीय आदकेश पलाररत वकयला गयला हहै। अततः अपर न्यलायलालययों दलारला पलाररत आदकेश अपलास्त हकोनके यकोग्य हह।
- अपपील वनम्न वविधधि कके सलारभिभूत प्रश्नयों पर ससुनविलाई हकेतसु असिंगपीककत ककी जलातपी हहै:-
- (i). क्यला अविर न्यलायलालययों नके अपपीललारर्थी कके दलारला प्रस्तसुत मिमौधखिक तरला अवभिलकेखिपीय सलाक्ष्ययों कला ससिंजलान धलयके वबिनला वविधधि -वविरुद्ध आदकेश पलाररत वकयला हहै? यवद हलाह, तको इसकला प्रभिलावि?
