Having heard Sri Nagendra Kumar Singh, learned counsel for the appellant and perused the record, we find no good ground to interfere in the order dated 06.04.2024 passed by the learned Principal Judge, Family Court, Ghazipur in Matrimonial Suit No. 299 of 2022 (Ajay Pratap Singh Vs. Smt. Sushmita Kushwaha) whereby interim maintenance has been awarded in favour of the respondent @ Rs. 8,000/- per month from the date of that order and further Rs. 25,000/- has been awarded by way of lump sum legal expense.

On the own showing of the appellant, the proceedings for divorce instituted by the appellant are pending.

On query made, learned counsel for the appellant states, the appellant is working at a private establishment, earning about Rs. 37,000/- per month.

Seen in that light, the award of interim maintenance at the rate less than 25% of the basic salary of the appellant that too from the date of the order, does not call for any interference. Similarly, in view of the above fact, Rs. 25,000/- awarded towards one time legal expense, is wholly just and proper.

Subject to the appellant cooperating in the proceedings and continue to pay the maintenance awarded as and when it becomes due, the learned court below may make best efforts to conclude the proceedings at the earliest, without allowing for any undue or long adjournment to the respondent.
