- Heard Sri Abhinav Shukla, learned counsel for the appellant, Mr. Abrar Ahmad Siddiqui, learned counsel appearing for claimant-respondent no. 1 and perused the record.
- This first appeal from order under Section 30 (1) of the Employee's Compensation Act, 1923 has been filed on behalf of appellant against the judgment and award dated 26.4.2024 passed by the Employees Compensation Commissioner and Deputy Labour Commissioner, Bareilly Division, Bareilly in Case No. 240 / ECA / 2021 (Smt. Sunehara Begum Versus The New India Assurance Company Ltd. through General Manager and another) by which compensation of Rs. 8,75,058/- has been awarded in favour of claimants-respondents.
- It is submitted by learned counsel for the appellant that the claimant has failed to prove that Irshad Khan was murdered during the course of his employment. It is further submitted that it was a case of murder and first information report under Section 304 IPC was lodged by the brother of the deceased, the claim petition under the Employee's Compensation Act itself is not maintainable.
