Vakalatnama filed today by Shri Sushil Kumar Singh, Advocate, on behalf of respondent no. 2 is taken on record.

Shri Sushil Kumar Singh, learned counsel for the respondent no. 2 states that the respondent no. 2 is not willing to go for mediation as the revisionist has already married and has purchased properties in the name of second wife which itself indicates that the revisionist is having ample means to sustain himself and to purchase property in the name of the second wife.

Upon a specific query being put to learned counsel for the revisionist as to whether the revisionist has got married, he on the basis of instructions given by the revisionist submits that in fact he has got married a second time.

Responding to that Shri S. K. Singh states that on the one hand the revisionist has failed to pay maintenance as has been directed by learned family court which arrears as of date is approximately Rs 18 lakhs and odd and the revisionist after getting married has also purchased two properties in the name of his second wife which itself indicates that the revisionist is having ample means to sustain himself and to purchase properties in the name of second wife and more particularly considering the fact that no divorce in accordance with law has taken place with the respondent no. 2 as such the conduct of respondent no. 2 would also fall within the ambit of bigamy.

However, as the khataunies are not on record, as such Shri Sushil Kumar Singh prays for and is granted three days time to file a supplementary affidavit duly bringing on record the said khataunies.

By the next date of listing learned counsel for the revisionist would also seek instructions from his client as to whether the property has been purchased in the name of his second wife.
