- Sri Mohd. Shoeb Khan, learned counsel for the revisionist and Sri Triveni Sharan Rai, learned counsel for the State are present.

- Vide order dated 13.08.2024 notice was issued to the opposite party no.2 /first informant & opposite party no.4 / Child Welfare Committee, District Gorakhpur. As per the office report dated 05.09.2024 a report regarding service of notice has been received. The report dated 28.08.2024 of the Chief Judicial Magistrate, Gorakhpur is on record which states that notice has been served on the opposite party nos.2 & 4. Despite service of notice, no one appears on behalf of the opposite party no.2 / first informant.

- Learned counsel for the State states that he has not received instructions in the matter.
