The order dated 06.02.2024 passed by learned Additional Special Judge (POCSO Act)/Additional Sessions Judge, Court No. 22, Kanpur Nagar in Special Session Trial No. 1076 of 2023 arising out of Case Crime No. 219 of 2013 (State vs Harsh Kushwaha and others), under Section 202 I.P.C. and Section 21 POCSO Act, Police Station Rawatpur, District Kanpur Nagar, whereby the discharge application of the revisionist under Section 227 Cr.P.C. has been rejected, is the subject matter of challenge in the present case.
At the outset, learned A.G.A. pointed out that after passing the order dated 06.02.2024, further 12.02.2024 was the date fixed for framing of charge, whereas learned counsel for the accused-revisionist submits that he is not aware whether charge against the revisionist has been framed or not.
Let a report be called for from the concerned Presiding Officer with regard to present status of trial of the revisionist by the next date.
