1.Heard Sri Akhilesh Kumar Tiwari, learned counsel appearing for the revisionist and Sri Raj Kumar Singh, learned counsel appearing for Opposite Party No.2.
- In compliance of this Court's order dated 23.10.2024, the learned counsel appearing for the revisionist has produced a Demand Draft of Rs. 40,000/- issued in favour of Opposite Party No. 2.
- The aforesaid Demand Draft has been handed over to Opposite Party No. 2, who is present in the Court in person.
- Learned counsel appearing for the revisionist has argued that the revisionist filed a Case under Section 9 of the Hindu Marriage Act which had been allowed vide order dated 2.11.2023, whereby direction had been issued to the wife for restitution of conjugal rights. It has further been argued that till date the order dated 2.11.2023, neither has been challenged before any higher forum nor the wife is willing to live with her husband.
