Sri Prabhat Kumar Mishra, Advocate holding brief of Sri Prem Prakash Singh, learned counsel for the revisionist and learned A.G.A. for the State are present.
This Court on 17.09.2024 passed the following order:-
"Heard.
Contention of learned counsel for the revisionist is that there is every likelihood of the parties settling the dispute in case the matter is referred to Mediation Center of this Court.
Considering the aforesaid, issue notice to respondents no.2 and 3. Steps be taken within a week.
List this case on 17.10.2024 as fresh on which date respondent no.2 shall either appear in person or through her counsel to indicate as to whether she is willing to go for mediation with the revisionist in order to settle out the differences.
In order to show his bona fides, let a sum of Rs.20,000/- be deposited by the revisionist before this Court within a period of two weeks from today.
It is provided that in case the revisionist deposits a sum of Rs.20,000/- before this Court within the aforesaid period then no coercive action shall be taken against the revisionist till the next date of listing in pursuance to the order dated 13.06.2024 passed by learned Principal Judge, Family Court, Ambedkar Nagar in Case No.414 of 2018.
Needless to mention that in case the aforesaid amount is not deposited within the time specified then the benefit of this order would not be available to the revisionist."
Office report dated 16.10.2024 reveals that the revisionist has not deposited the amount of Rs.20,000/- (Rupees twenty thousand only). The notice upon opposite party nos.2 and 3 has been served through heir.
Learned counsel for the revisionist has submitted that that, due to financial constraints, the present revisionist is unable to comply with the direction issued vide aforesaid order dated 17.09.2024.
List this matter after four weeks.
Meanwhile, learned counsel for opposite party no.2 shall file counter affidavit.
It is made clear that as the revisionist has not complied the aforesaid order dated 17.09.2024, therefore, the interim order dated 17.09.2024 stands discharged.
