The opposite party nos. 2 and 3 are present before this Court, who have been identified by Shri Mohd. Jishan, Advocate and Shri Sanjeev Verma, Advocate who have filed the Vakalatnama on their behalf which is taken on record.

Instant revision under Section 19(4) of the Family Courts Act has been filed challenging the order dated 30.08.2024 passed by learned Additional Principal Judge, Family Court II, Raebareli, in Case No. 120 of 2020 in re: Faizi Ahmad vs Saleha Faruki.

On 09.09.2024, this Court passed the following order:

"1. Heard.

¶10

2. Instant revision under Section 19(4) of the Family Courts Act has been filed challenging the order dated 30.08.2024 passed by learned Additional Principal Judge, Family Court II, Raebareli, in Case No. 120 of 2020 in re: Faizi Ahmad vs Saleha Faruki.

3. Learned counsel for the revisionist states that there is every likelihood of the parties entering into a settlement in case the matter is referred to Mediation Center of this Court.

4. Considering the aforesaid, issue notice to respondents no.2 to 3 returnable at an early date.

¶13

5. List this case on 03.10.2024 as fresh on which date the respondent no. 2 shall either appear in person or through counsel to indicate whether she is willing to go for mediation.

6. It is further provided that in case an amount of Rs.20,000/- is deposited within two week from today before this court to show his bona fide, no coercive action shall be taken against the revisionist.

7. It is needless to mention that in case the revisionist fail to deposit the amount of Rs.20,000/- within a period of two weeks, benefit of this order shall not be available to him."

It is stated by learned Counsel for the parties that the dispute which is

a matrimonial dispute could be settled and decided amicably by way of mediation.

Taking note of the aforesaid, let the matter be placed before Mediation and Conciliation Centre of this Court on 18.10.2024. On appearance of party No. 2, the amount deposited by the revisionist, in terms of the order dated 09.09.2024, shall be released in her favour.

List/put up this case before this Court on 12.12.2024 as fresh along with mediation report in this regard showing the name of Shri Mohd. Jishan, Advocate and Shri Sanjeev Verma, Advocate as counsel for opposite party nos. 2 and 3.

Till the next date of listing, the proceedings in issue against the applicants shall be kept in abeyance.

Learned counsel for the parties shall ensure the presence of the parties before the Mediation and Conciliation Centre of this Court on the date fixed by this Court.

It is made clear that in case settlement is not arrived at between the parties, the benefit of interim order would not be available to the revisionist.
