Shri Promod Kumar Yadav, learned Advocate has filed his 'Vakalatnama' on behalf of the opposite party no.2, the same is taken on record.

In pursuance of the earlier order of this Court dated 05.09.2024, Rs. 50,000/- appears to have been deposited by the revisionist.

Shri Promod Kumar Yadav, learned counsel for the opposite party no.2 informs that he under instructions is making a statement that opposite party no.2 is not having any objection if the dispute is referred for mediation.

Though learned counsel for the revisionist is not available, however, his willingness to enter into the process of mediation is evident on record as he has already consented, which has been recorded in the order dated 05.09.2024 and also from the fact that he has deposited Rs.50,000/- in this regard.

Thus keeping in view the consent given by the opposite party no.2 through her counsel Shri Promod Kumar Yadav, the dispute between the parties is referred for mediation. The parties shall appear before the Mediation and Conciliation Centre of this Bench on 16.10.2024. The money, which has been deposited by the revisionist, shall be paid to the opposite party no.2 on her first appearance before the Mediation and Conciliation Centre, however, this amount would be subject to adjustment with regard to any arrears under the orders of the trial court of date 05.07.2024.

The mediator appointed by the Incharge, Mediation and Conciliation Centre shall make all out efforts to persuade the parties to arrive at an amicable settlement and shall submit a report to this Court after conclusion of the mediation proceedings preferably within next two months from today.

7. List this case on 03.12.2024 before appropriate Bench.

It is provided that till the next date of listing, any proceedings with regard to realization of recovery of maintenance shall remain suspended.

The name of Shri Promod Kumar Yadav, learned counsel shall be printed in the cause list as counsel for the opposite party no.2 when the case is next listed.
