Heard learned counsel for the petitioners and learned A.G.A. for the State.

Learned counsel for petitioners is permitted to implead wife as respondent no.5.

Let necessary correction/impleadment be made during the course of the day.

In compliance of the order of this Court dated 18.10.2024 a demand draft of Rs.40,000/- in favour of the wife is produced by the petitioner today in the Court.

Learned counsel for petitioners prays that the matter may be referred to the Mediation and Conciliation Centre of this Court as there are chances of amicable settlement between the parties through mediation.

It is very difficult for this Court to refer the matter to the Mediation Centre without knowing the consent of the other side.

In order to ascertain the willingness of opposite party no.4 and 5, let notice be issued to opposite party no.4 and 5, to be served through the Station House Officer, Police Station

Kaiserbagh, District Lucknow (opposite party no.3), for their appearance before this Court on 04.11.2024.

List this case on 04.11.2024.

¶15

On that date, the petitioners and opposite party no.4 and 5 shall appear in person to apprise the Court as to whether they are willing to resolve their dispute through Mediation and Conciliation of this Court or not.

Respondent no.3-Station House Officer, Police Station Kaiserbagh, District Lucknow shall ensure presence of opposite party no.4 and 5 before the Court on the next date.

Petitioners will retain demand draft of Rs.40,000/- for producing before this Court on 04.11.2024.

Till the next date of listing, the petitioners shall not be arrested in the F.I.R./Case Crime no.163 of 2023 under Sections 498-A, 323, 506 and Section 3/4 of D.P. Act, Police Station Kaiserbagh, District Lucknow subject to full cooperation in the investigation of the case.
