Heard learned counsel for the appellants, learned A.G.A for the State and perused the record.

This Criminal Appeal has been preferred under Section 14-A (1) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 to set aside the cognizance order dated 02.08.2024 passed by Special Judge (S.C./S.T. Act), Ghazipur as well as charge sheet dated 26.06.2024 in Special Sessions Trial No. 591 of 2024 (State Vs. Gorakh Nath Yadav and others) arising out of Case Crime No. 114 of 2024, under Sections 147, 323, 504, 506, 325 IPC, Sections 3(1)(r), 3(1)(s) and 3(2)(v-a) of the SC/ST Act, Police Station-Mohammadabad, District-Ghazipur.

Learned counsel for appellants submits that he is not pressing the appeal on merits and the present appeal may be disposed of finally with the direction to the court below that in case appellants surrender before the court below and apply for bail, their bail applications may be considered and decided expeditiously in accordance with law, including the law laid down in the case of Satender Kumar Antil Vs. Central Bureau of Investigation and another, (2021) 10 SCC 773.

Learned A.G.A. for the State has opposed the appeal.

For a period of 30 days from today or till the time of applying the bail application before the court concerned, whichever is earlier, no coercive action shall be taken against the appellants.

The instant appeal is disposed of, accordingly.
