The counsel for the applicant is permitted to implead Deepak Kumar, the present Principal Secretary (Home) Government of Uttar Pradesh, Lucknow as opposite party no. 3 in Contempt Application No. 616 of 2024 during the course of the day.

The other contempt applications connected with Contempt Application No. 616 of 2024 involve a similar issue as raised in the present contempt application regarding non-compliance of the different orders passed by this Court in writ petitions filed by the Constables employed either with the U.P. Police or with the Provincial Armed Constabulary seeking additional increment after counting the period spent by them in training. Similar orders were passed in all the writ petitions.

The previous Principal Secretary (Home) has already been impleaded as opposite party in connected contempt applications. However, it is stated in an affidavit filed today in the Contempt Application No. 616 of 2024 that Sanjay Prasad, the previous Principal Secretary (Home) had been transferred by the order dated 19.03.2024, therefore, it was not possible for him to comply with the order dated 19.03.2024 passed by this Court wherein the Principal Secretary (Home) was granted two months' further time to comply with the orders of the writ Court. Contempt applications have been occasioned because of non-compliance of the orders passed by the writ Courts as mentioned above.

In view of the aforesaid, Deepak Kumar, the present Principal Secretary (Home) Government of Uttar Pradesh, Lucknow is not required to be impleaded in all the contempt applications as notice of the said contempt applications has already been served in the office of the Principal Secretary (Home). The order dated 19.03.2024 is to be complied by the Principal Secretary (Home) Government of Uttar Pradesh, Lucknow also so far as the connected contempt applications are concerned.

List again on 8th August, 2024 on which date, Deepak Kumar, the present Principal Secretary (Home) Government of Uttar Pradesh, Lucknow shall either file a compliance affidavit showing compliance of the orders passed by the writ Court and involved in all the connected contempt applications or be personally present in this Court for framing of charges.
