Present contempt petition has been preferred for noncompliance and willful disobdience of the judgment and order dated 31.05.2024 passed in Writ C No. 5122 of 2024.

Learned counsel for the applicant has submitted that the applicant has preferred a petition bearing Writ C No. 5122 of of 2024 challenging the order dated 30.10.2023 passed under Section 17 (3) of the Arms Act revoking petitioner's arms license and also the appellate order dated 07.05.2024 rejecting the appeal preferred by the applicant. Both these orders have been stayed by this Court by passing an interim order dated 31.05.2024 until further order of this Court. Despite the said order staying the operation of the impugned orders therein dated 30.10.2023 and 07.05.2024, the respondent District Magistrate, District Unnao in place of restoring the arm license of the applicant, has refused to pass any order for continuation of the arms license and kept in abeyance on the ground that the writ petition is pending and directed the applicant to deposit the fire arm.

This Court had issued notice to the respondent on 21.09.2024 but today neither the respondent is present nor any affidavit of compliance has been filed, however he has sent instructions to the learned Standing Counsel, reiterating the stand as it is stated in the order passed earlier.

Let the respondent-Gaurang Rathi, District Magistrate, District Unnao appear before this Court in person on 27.11.2024 for the purpose of framing charges.
