Heard learned counsel for the applicant and learned Standing Counsel.

This application under Section 12 of the Contempt of Courts Act has been filed alleging wilful disobedience of the judgment and order dated 21.02.2024 passed on Writ-C No. 9952 of 2023.

Learned counsel for the applicant submits that as the request for renewal of arm license of the applicant was cancelled, the said rejection order was challenged before this Court in Writ-C No. 9952 of 2023, which was allowed vide order dated 21.02.2024 after exchange of the affidavit.

As the aforesaid order was not complied with, the present contempt proceedings have been initiated and notices were issued to the respondent on 23.05.2024. As per the report of Chief Judicial Magistrate dated 20.07.2024, notice has already been served on the respondent.

On 08.08.2024, it was informed by Shri Ramswaroop, learned Standing Counsel that Special Appeal against the aforesaid order is pending, therefore, contempt proceedings may be deferred. The said prayer was declined with the further direction that the matter be listed in the 1st week of September, 2024 within top 10 cases, by which time, the respondent shall file affidavit of compliance.

Counsel, on the basis of written instructions of the respondent-Mr. Sanjeev Ranjan, District Magistrate, Pratapgarh, informs that as the Special Appeal is pending, therefore, the contempt proceedings may be deferred.

Admittedly, mere pendency of Special Appeal is no ground to defer the contempt proceedings and, therefore, the prayer for deferment is hereby rejected.

List this case on 20.09.2024.

By the next date of listing, affidavit of compliance be filed by the respondent, failing which, he shall appear before this Court.
