1. On 26.7.2024, following order was passed:-
1. Shri Sunil Bajpayee, learned Additional Chief Standing Counsel, on the basis of instructions of the respondent, prays for deferment of the contempt application on the ground that a Special Appeal has already been filed against the order of the writ Court.
2. Learned counsel for the applicant, however, submits that the said Special Appeal is defective and the delay in filing the same has not been condoned.
3. Considering the submissions of the learned counsel for the parties and the fact that merely filing of a defective Special Appeal cannot be a ground to defer the contempt proceedings, the request of the learned Standing Counsel is hereby rejected.
4. List this case on 21.08.2024, as fresh.
5. The respondent is directed to file affidavit of compliance by the next date, failing which, he shall appear before this Court.
