Heard learned Counsel for the applicant as well as learned A.G.A. and perused the record.

Submission of Counsel for the applicant is that the basis for invoking the provisions of Gangsters Act against the applicant is the two cases which have been shown in the gang chart and in the said two cases, the applicant is on bail. Hence, the applicant who is in custody since 25.7.2023, may be released on bail.

Per contra, learned A.G.A. has opposed the bail prayer of the applicant.

Considering the submissions made by learned counsel for the parties and and keeping in view the fact that the applicant has already been enlarged on bail in two cases shown in the gang chart, I am of view that the applicant is entitled for bail.

Accordingly, the present application is allowed.

Let the applicant Kuldeep Singh @ Deepak Singh be released on bail in Case Crime/ FIR No.0175 of 2023, under Sections 2/3(1) of the U.P. Gangsters and Anti-Social Activities (Prevention) Act, 1986 registered at Police Station Samngrampur, District Amethi on his furnishing a personal bond with two sureties of the like amount each to the satisfaction of court concerned with the following conditions: -

(a) The applicant shall execute a bond to undertake to attend the hearings;

(b) The applicant shall not commit any offence

¶14

similar to the offence of which he is accused or suspected of the commission; and

¶15

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
